It sounds boring and incomprehensible, but, apparently, the publication of these same protocols seriously frightened the officials. At the very least, a man from the city hall began to threaten Novichkov and demanded that the publication be removed. The news quickly spread through the media. The fact of threats only spurred interest in what was published.

- Andrei, what kind of threats did you receive?

- The mayor's office is afraid that the people will protest?

Of course. Therefore, such a level of secrecy in these documents. Even under Luzhkov, this was not the case - at least through the deputies or through the court it was possible to obtain all the documentation for the construction. But not now. Therefore, in general, we were ready for such a reaction on their part, for threats.

- And specifically - what do these threats mean?

And this - sit and think. It is not customary now to threaten openly, but with such "hints". Well, the first thing that comes to mind is, of course, the fabrication of cases against us. Well, or there they can watch in the entrance, for example ...

- What are you planning to do about it?

We have discussed with lawyers and will most likely file a complaint with the police. Of course, they, as usual, will say that these are no threats. But for us the main thing is to fix this fact.

I can only say that the mayor's office did not achieve its goal. We will not delete any documents, and the source of information - knowing that it is in danger - now we certainly will not disclose.

While the material was being prepared, it became known that Andrei Novichkov turned to the police with a statement about threats.

Not many Muscovites, who have not personally encountered yet another urban planning "mistake" in the form of a built-in point building directly in their yard, have thought about how, in fact, such decisions are made in the main Russian city. Metropolitan authorities long years kept documents under lock and key, which a priori should be available to all Muscovites. And now the secret decisions on the development of the city, secretly adopted by the top of the city officials, operating the entire period of Sobyanin's rule, have finally become public. Naturally, against the will of Sobyanin's entourage.

The information publication Fronde TV (whose journalists are already being threatened - therefore we recommend that all fellow citizens participate in the distribution and analysis of materials, as well as promptly download them to their personal archives - we provide links at the end of this article) published documents that the city authorities have kept all these years in the strictest confidence. These documents were not provided to anyone: neither ordinary citizens nor deputies.
We are talking about the Protocols of the Interdepartmental Urban Planning and Land Commission, a permanent body of the Moscow Government, where decisions on construction throughout the capital are made at weekly meetings chaired by Sergei Sobyanin. It is on the basis of these documents that historical buildings and green spaces have been destroyed and continue to be massively destroyed, squatter construction is legalized and "launching sites" for the infamous renovation are determined.

The Urban Planning and Land Commission (GZK) was established in November 2010 on the initiative of Sergei Sobyanin and was officially called upon to function as a recommendatory body that considers issues in the field of construction in Moscow. But very quickly, this commission began to work behind closed doors, making decisions on a total change in the appearance of the entire capital, without the participation of representatives of the scientific, expert, local history and environmental community. In fact, the commission does not recommend, but obliges the authorities state power in the field of architecture, ecology, protection of cultural heritage to implement certain projects.

For 8 years of existence of the GZK:
- hundreds of decisions were made on the demolition of historical buildings and new construction in their place, among them - the Privalov House on Sadovnicheskaya Street, the Melgunov estate on the old Arbat, the Serafimovich House of Culture in Sredny Tishinsky Lane, the house of the merchant Mikhailov on Bolshaya Dmitrovka, the Taganskaya ATS on Pokrovsky Boulevard, the estate of Neklyudova on Malaya Bronnaya, the military hospital of the Red Cross on Krasnokazarmennaya street, tenement houses on Varvarka street and hundreds and hundreds more addresses.
- construction of more than 500 parks and green areas is allowed, including Friendship Park at the River Station, Dubki Park, Torfyanka Park, Kuskovo Forest Park, and a park on Zhivopisnaya Street.
- given for reconstruction, and in fact for complete or partial demolition, hundreds of buildings of architectural and memorial value, including the Bolkonsky House from "War and Peace" on Vozdvizhenka, the swimming pool of the Luzhniki Olympic Complex, the commercial houses of Kuznetsov and Korolev in the Orda dead end , the estate of Sokolov-Sibiryakov in Voznesensky Lane, a historical quarter on Sofiyskaya Embankment, opposite the Kremlin.
- legalized more than a thousand objects of unauthorized construction throughout Moscow. Instead of taking administrative and criminal measures against persons erecting buildings without permits, the commission, after a short time, stamps out decisions “on the preservation of objects that have signs of unauthorized construction.”

Contrary to the requirements of Article 24 of the Constitution Russian Federation, the Commission's decisions are kept in the strictest confidence and are not made available to citizens. Refuse to familiarize and deputies of different levels. Thus, it is physically impossible to know about the decisions that are made at the meeting. Only occasionally does the press service of the mayor report some events to the commission, leaving behind the scenes thousands of decisions taken contrary to the opinion of the city's residents and the professional community.

In 2016, the Human Rights Council under the President of Russia also spoke about the lack of transparency and accountability of the commission, which called for its abolition. At the same time, the public movement Arkhnadzor also called for the liquidation of the SLC at a rally, but large developers spoke out against it. Of course, human rights activists are sure that this should not be the case. Any decisions taken by the authorities must be available for review and discussion with citizens.

A cursory analysis of the documents, provided by an anonymous source from the capital city hall, allows us to establish that the GZK works like a conveyor belt. Meetings are held every week, and at each meeting several dozen issues are considered, sometimes more than a hundred. These issues include all construction projects in Moscow, including decisions on developments covering several million square meters. Moreover, each meeting of the commission usually lasts no more than an hour. That is, it takes an average of about a minute to consider one question.
For example, the meeting of the powerful body on April 14, 2012 lasted 50 minutes, 64 issues were considered. And the meeting of the State Legislative Committee on December 27, 2013 lasted 35 minutes, while 75 issues were considered. Consideration of each of the issues submitted for discussion by the all-powerful commission, on average, took exactly 28 seconds. During this time, it is impossible even to voice a decision, let alone discuss it.
But that's not even the most interesting part. From the documents received, it becomes clear that after signing the protocols, they can be completely arbitrarily amended, seriously changing the project in the interests of developers. These changes include a reduction in kindergarten almost 2 times; reduction in the number of parking spaces by 10 times; an increase in the building height by almost 3 times; changing the purpose of the land plot from “beautification and gardening” to “placement of a retail facility” and even “initiating amendments to federal laws”.
All these changes are made after a very long time after the approval and signing of the protocols (for example, in one of the cases this happened after 3 years) by letters from individual officials on behalf of unknown persons. To give these changes the appearance of legitimacy, they are sometimes bashfully referred to as "technical changes".

Similar changes were made to the vast majority of the SLC protocols for 2012. It cannot be ruled out that similar changes have also been made or will be made in the future to any other protocols of the commission.

We urge you to download and analyze these materials (primarily in your own regions), as well as a huge request to participate in the distribution of this collection of "secret" SLC protocols. Information should be available to the maximum number of Muscovites! This is the only way to ensure a reasoned protest against Sobyanin's behind-the-scenes "waving" to developers, as well as protection for journalists who are already being pressured in the form of telephone threats and demands to remove the SLC protocols from public access.

In mid-July 2016, a number of changes were made to the Regulations on the SLC (urban planning and land commission) of the city of Moscow. At the same time, few of the participants in the construction sector know what tasks the commission has been created to solve, what powers it has, and in what cases meetings on land issues are held. These aspects will be the focus of this article.

So, the main goal of creating the SLC is to quickly solve the problems associated with urban planning activities, as well as issues of the land sector. Also, the powers of the commission include resolving issues regarding the construction and overhaul of buildings, including those related to cultural heritage sites.

Discussions are held in the format of a meeting, the result of which is the preparation of minutes and the adoption of a certain decision. At the same time, all decisions made by the land commission come into force only after the signing of the final document. The peculiarity of the SLC is that it considers issues only within the limits of its existing competence, without fulfilling the tasks assigned to the government of the city of Moscow and the region.

During the meeting, various issues may be considered, the introduction of which is the task of the Chairman. The functions of deputies can be performed by the heads of subgroups on various issues. The secretary is responsible for holding the meeting and drawing up the minutes.

What functions are assigned to the GLC?

One of the key issues is the functions that the land commission takes on. In the process of holding meetings, specialists in areas make decisions on making adjustments to the master plan of Moscow and the region. The SLC also has the right to approve the following projects:

  • Schemes of the territorial and sectoral sector, thanks to which the implementation of urban planning activities within the existing state programs of the city is guaranteed.
  • Rules for the use of land, measures for the development of Moscow, as well as making adjustments to the documentation.

In addition, the city planning commission makes decisions regarding the approval of:

  • Projects of nature protection zones related to objects of cultural heritage. It also determines the modes of use of land plots in close proximity to the above-mentioned objects of the city of Moscow and the region.
  • Lists of land plots, the rights of which can be transferred through the organization of auctions (bidding) with the subsequent construction of objects in the housing sector.
  • Planning projects for the territory of the capital before the entry into force of the rules for the use of land, as well as structures of the city of Moscow.
  • Rules for the use of land, as well as facilities within the capital, which are prepared on the basis of applications from citizens and representatives of companies (legal entities). In particular, we are talking about the objects of individual housing construction, land for agricultural use, as well as plots located outside the Central Administrative District of Moscow.

In addition to the functions listed above, the SLC takes on a number of other tasks - assessing the urban development potential of the capital, reviewing, as well as approving (rejecting) projects for the development of a network of public toilets, stopping the development of a project for building plots, and so on.

In addition to global issues related to the territory (structures) of the city of Moscow and the region, more “small” problems are also resolved at the meetings (including financial plan). These include decisions related to the application of penalties, changes in the construction (reconstruction) terms of facilities, termination (termination) of lease agreements, the installation of easements, and so on. Meetings are held on each of the issues and minutes are drawn up.

As a result, the urban planning commission of the city and region takes on a wide range of tasks related to decision-making in the construction industry. This also includes work related to investment activities. Decisions are also made regarding the preparation and terms of registration of concession agreements.

The powers of the SLC include making decisions regarding agreements drawn up with entrepreneurs and citizens on the transfer of city funds for the construction (reconstruction) of structures (houses, highways).

How does the commission work?

The City Planning Commission is a permanently functioning body of the city of Moscow and the region, whose activities are carried out taking into account the current regulations, and decisions are confirmed by the protocol and approved by the chairman. The frequency of meetings is not rigidly fixed, they can be held as needed twice a month (minimum). It should be noted that the town planning commission of the SLC should make decisions only if the number of participating members is 50% or more. Otherwise, the decisions taken at the meetings are not valid.

What do you need to know about GZK decisions?

Special attention should be paid to the decision-making of the town planning and land commission. Thus, meetings concerning the objects of the city of Moscow and the region are held subject to strict adherence to the legislation of the Russian Federation. In addition, the issue is considered resolved if the members present agree. If there are disagreements on certain issues, the decision is made by voting and recording the results in the minutes. If there is a vote, then the decision is made if there is a greater number of votes. In a situation where opinions are divided equally, the last word remains with the Chairman of the State Legislature. In the absence of the chairman, the main word remains with the deputy.

Based on the results of the meeting, the secretary draws up a protocol, where decisions made. Within ten days from the date of the meeting, the minutes must be signed by the secretary (responsible person). After registration of the document, its copy is sent by the secretary to the authorized bodies of the capital (region). There are three days for sending from the date of approval of the protocol. Extracts from the document must be sent on the basis of a written request.

Tasks of the commission members

Each of the members of the town-planning and land commission undertakes certain tasks. So, the functions of the chairman should include the management of the work of the SLC. If there is no head, then his functions are taken over by the deputy. In addition to the direct managerial function, the chairman (deputy) manages the work of the commission, distributes obligations among members, approves the preparatory regulations, transfers his functions to other members of the commission (if necessary).

Not less than important questions- Drawing up the agenda of the meeting and taking minutes. These questions lie with the responsible secretary. Authorities can be transferred to the heads of working subgroups.

There is also a Committee for Moscow and the region, which ensures the implementation of investment projects in the construction sector, and also controls shared construction.

Certain functions are taken over by the working groups. Their authority may include the preparation and organization of meetings. At the same time, several different subgroups are created - an urban planning commission on investment, urban planning and other types of activities. The composition of such commissions includes the heads of various bodies in the construction sector (territorial, functional and sectoral).

The minutes of the meetings held by each of the subgroups must be approved by the chairman of the town planning commission. The work of the subgroups is regulated on the basis of the current regulations.

The powers of the SLC working groups for Moscow and the region should also include preparatory work in relation to draft decisions, resolving issues related to the implementation of investment projects, and so on.

The function of monitoring the implementation of decisions of the SLC lies with the secretary, who takes on a number of tasks:

  • Providing data on the implementation of the decisions of the Commission in the sector of indicators (relative and absolute) that affect the overall situation in the sociological and environmental sector.
  • Organization of operational meetings on issues related to the implementation of the decisions of the commission. At the same time, data on the holding of meetings is provided at meetings of the SLC along with data on the implementation of certain decisions.

The regulation on the work of the commission can be adjusted, but only at the direction of the Moscow Government.

Consideration of issues in the field of land relations during construction (reconstruction, restoration), as well as the operation of facilities in the city of Moscow: - on the provision of land plots for the design and construction (reconstruction) of capital construction facilities with prior approval of the location of the facilities or without prior approval of the location objects (with or without tenders (competitions, auctions); - on changing the purpose of providing land plots, if such changes provide for the design and construction (reconstruction) of capital construction facilities on the land plot; - on changing the deadlines for fulfilling the obligations of developers for design , construction, commissioning, established by contracts for the lease (use) of land plots; - on changing the general (limit) periods for the lease of land plots; - on the provision of land plots for the purposes of operation of capital construction facilities and other purposes not related to construction located within the boundaries of a specially protected natural area, a public area. 2.3. Consideration of issues related to the implementation of investment projects and execution of acts of implementation of investment contracts (agreements), the subject of which is the construction, reconstruction of capital construction facilities, restoration of immovable cultural heritage objects: operation established by investment contracts (agreements); - on termination of the implementation of investment projects and termination (refusal to execute) of the relevant investment contracts (agreements); - on consent to the assignment of rights and obligations under investment contracts (agreements); - on changing the terms of investment contracts (agreements) on the division of the areas required for the operation of the facility, according to the actual data of the cadastral registration of the property. 2.5. Consideration of issues on the application of liability measures for failure to comply with the terms of land lease agreements and investment contracts (agreements). 2.7. Consideration of issues on recognizing as invalid the legal acts of the city of Moscow on the issues of construction, reconstruction of capital construction projects, restoration of immovable objects of cultural heritage and termination (restriction) of urban planning and economic activities on the relevant land plots (territories) in cases where such activity violates the laws of the Russian Federation and the city of Moscow. 2.8. Listening to reports on the commissioning of facilities, compliance with or violation of construction deadlines, and prompt response measures taken. 2.9. Consideration and resolution of other issues included in the agenda of the Commission meeting. 3. Rules of work of the Commission 3.1. The Commission is a permanent working body of the Moscow Government and carries out its activities in accordance with the regulations, which are approved by the Chairman of the Commission. 3.2. Decisions on holding a meeting of the Commission are made by the chairman of the Commission or, at his direction, the deputy chairman of the Commission. 3.3.
