In order to improve public administration in the field of control over the circulation of narcotic drugs, psychotropic substances and their precursors and in the field of migration, in accordance with Article 80 of the Constitution Russian Federation, Federal Constitutional Law of December 17, 1997 N 2-FKZ "On the Government of the Russian Federation" and until the adoption of the relevant federal law, I decide:

1. Abolish the Federal Drug Control Service of the Russian Federation and the Federal Migration Service.

2. Transfer to the Ministry of Internal Affairs of the Russian Federation:

a) the functions and powers of the abolished Federal Service Russian Federation for Drug Control and the Federal Migration Service;

b) the staffing level of the abolished Federal Service of the Russian Federation for Drug Control;

c) the staffing of the abolished Federal Migration Service, reducing it by 30 percent.

3. Establish that the Ministry of Internal Affairs of the Russian Federation is:

a) a federal executive body that performs the functions of developing and implementing state policy and legal regulation in the field of internal affairs, in the field of control over the circulation of narcotic drugs, psychotropic substances and their precursors, in the field of migration, as well as law enforcement functions in federal state control (supervision) in these areas;

b) the assignee of the abolished Federal Drug Control Service of the Russian Federation and the Federal Migration Service, including for obligations arising from the execution of court decisions.

4. Determine that:

a) employees, federal state civil servants and employees of the authorities for the control of the circulation of narcotic drugs and psychotropic substances (hereinafter referred to as the drug control authorities) and the Federal Migration Service continue to perform their duties until the completion of the activities provided for by this Decree;

b) employees of the drug control bodies who have expressed a desire to enter the service of the internal affairs bodies of the Russian Federation (hereinafter referred to as the internal affairs bodies) are accepted for service in these bodies in the order of transfer without a probationary period and recertification. Such employees are not entitled to a one-time allowance;

c) employees of the drug control bodies, accepted for service in the internal affairs bodies in the order of transfer:

special ranks are assigned, corresponding to the special ranks assigned in the drug control bodies, but not higher than the special rank of colonel;

the terms of stay in special ranks during the period of service in the drug control bodies are counted when assigning the next special ranks;

length of service in the drug control authorities is counted towards the length of service in the internal affairs bodies for the purpose of assigning a pension, paying salaries and providing other measures of social support;

the periods and terms of granting basic and additional holidays, the settlement periods for calculating benefits and compensations calculated during service in the drug control bodies are preserved;

d) housing and social Security employees of the drug control bodies, accepted for service in the internal affairs bodies in the order of transfer, is carried out in accordance with the legislation of the Russian Federation.

5. Complete the organizational and staffing activities related to the implementation of this Decree by June 1, 2016.

6. To the Government of the Russian Federation:

a) ensure, in accordance with the established procedure, the transfer to the Ministry of Internal Affairs of the Russian Federation of property, including real estate, assigned to the abolished Federal Drug Control Service of the Russian Federation and the Federal Migration Service, which is necessary for the implementation of the functions and powers transferred to the Ministry of Internal Affairs of the Russian Federation ;

b) redistribute, in accordance with the established procedure, the budgetary appropriations of the federal budget in accordance with this Decree;

c) to ensure, within the terms established by the legislation of the Russian Federation, liquidation procedures in connection with the abolition of the Federal Drug Control Service of the Russian Federation and the Federal Migration Service;

d) submit proposals to clarify the maximum staffing of the internal affairs bodies and the central office of the Ministry of Internal Affairs of the Russian Federation;

e) bring their acts in line with this Decree;

f) submit proposals for bringing acts of the President of the Russian Federation in line with this Decree;

g) ensure the solution of financial, logistical and other issues related to the implementation of this Decree.

7. To the Ministry of Internal Affairs of the Russian Federation:

a) ensure the acceptance for processing of criminal cases, materials of inspections of reports of crimes, cases of operational records and other materials that are in the production of drug control authorities, as well as the continuity of the implementation of other functions and powers transferred to it, including the management of cases of administrative offenses abolished by the Federal Service of the Russian Federation the Drug Control Federation and the Federal Migration Service;

b) to ensure the preservation in the system of the Ministry of Internal Affairs of the Russian Federation of the territorial bodies of the abolished Federal Service of the Russian Federation for Drug Control;

c) submit proposals to clarify the list of positions of the highest commanding staff in the internal affairs bodies of the Russian Federation, in the Federal Migration Service, in the Bureau for Coordinating the Fight against Organized Crime and other dangerous species crimes in the territories of the member states of the Commonwealth Independent States and special ranks corresponding to these positions, approved

In April 2016, Vladimir Putin abolished the Federal Drug Control Service (FSKN), from the beginning of the summer its duties were transferred to the Ministry of Internal Affairs. The reform, although it was planned more than a year ago, came as a surprise to the employees of the disbanded service. The uncertainty was supposed to be resolved by a specially created interdepartmental commission, which, among other things, planned to engage in the employment of drug police and their re-registration as the staff of the Ministry of Internal Affairs.

The law “On Improving State Administration in the Sphere of Control over the Circulation of Narcotic Drugs, Psychotropic Substances and Their Precursors and in the Sphere of Migration,” signed by the President, states that the staffing of the Federal Drug Control Service is transferred to the Russian Ministry of Internal Affairs. The head of state himself during the April "Direct Line" assured that the employees of the disbanded department had no reason to worry - the reform does not imply mass cuts.

“As for the operational staff, the main contingent of workers, we are well aware that it cannot be reduced, no one is going to do this due to the importance of the tasks that this structure solves,” Putin said.

In addition to the Federal Drug Control Service, Vladimir Putin's decree abolished the Federal Migration Service (FMS), whose functions have now also been transferred to the Ministry of Internal Affairs. At the same time, the staff of the service was cut by 30%: the reductions affected about 11 thousand employees of the FMS.

As a result of the reform, the number of employees of the Ministry of Internal Affairs should increase by more than 64.5 thousand people.

The authorities planned to disband the Federal Drug Control Service by June 1, 2016, but the liquidation of the service had to be postponed. As noted by Gazeta.ru, the regulations necessary to transfer the functions of the drug police to the Ministry of Internal Affairs were not ready by the appointed date. However, the weapons arsenal, which belonged to the employees and fighters of the special forces of the Federal Drug Control Service "Thunder", was rather quickly handed over to the interdepartmental commission. The liquidation of the structure was extended until the end of the year.

In mid-July, the Public Chamber announced that more than half former employees drug control remain unemployed - 16 thousand people were never transferred to the Ministry of Internal Affairs, they receive neither salaries nor benefits. At the same time, part of the employees of the central office and territorial bodies have already been dismissed in connection with the transfer to another department, but they have not yet received any documents confirming their admission to service in the Ministry of Internal Affairs. Representatives of the ministry, in turn, explained that the re-registration of employees of the Federal Drug Control Service takes quite a long time. “We have to conduct special checks of candidates. If our own security gives good, then we immediately accept people. All this takes time. At the same time, everything that is required by law will be implemented,” said Sergey Kukharenok, a representative of the Civil Service Department of the Ministry of Internal Affairs, at a meeting with members of the Public Chamber. He added that preference will be given to those who have a higher legal education and "the necessary clearances."

How they are fired in Transbaikalia

While the FSKN officers are waiting to be re-registered by the Ministry of Internal Affairs, many drug police have already received notices about the refusal to accept them into the ranks of the police. This happened, in particular, in the Trans-Baikal Territory, where several employees of the disbanded service filed a lawsuit against the regional Ministry of Internal Affairs.

“In Transbaikalia, 49 former employees of the Federal Drug Control Service were not hired (in total, about 250 employees worked in the regional department of the department - the Ministry of Health). The majority, mainly the leadership of the disbanded Federal Drug Control Service, retired, and nine people filed a lawsuit,” Roman Sukachev, a lawyer at the Trans-Baikal Human Rights Center, told Mediazona.

The lawsuit filed against the Ministry of Internal Affairs (a copy of the document is at the disposal of Mediazona) notes that the employees of the Federal Drug Control Service received a refusal to hire after an inspection by the internal security department (OSB) of the Ministry of Internal Affairs. How exactly the check was carried out, the drug police do not know, but according to its results, they were denied a position.

In his lawsuit, the former employee of the Federal Drug Control Service Ivan Ivanov, who asked Mediazona not to disclose his real name and surname, indicated that the check was carried out with violations: he did not give the Ministry of Internal Affairs consent to the processing of his personal data, since his position in the internal affairs bodies not yet offered at the time of the audit.

According to "Ivanov", at the general meeting of the FSKN on Trans-Baikal Territory the head of the personnel department of the regional Ministry of Internal Affairs, police colonel Yuriy Protiven, said that employees who were not recommended by the internal security unit would be denied employment, but ex-FSKN employees would not receive a written refusal. Soon "Ivanov" and his colleagues were given work books, which indicated that they were dismissed from service in connection with the transfer to another department. At the same time, the Ministry of Internal Affairs did not hire them and did not pay them any monetary compensation.

Courts and appeals

In the regional Ministry of Internal Affairs, the refusal to hire FSKN employees was explained by their “inconsistency with the moral, business and moral qualities” that a candidate for police service should have.

“The presidential decree does not establish the obligation of the internal affairs bodies to recruit employees of the Federal Drug Control Service without carrying out verification measures established by law. Today, 58 former drug police officers have been accepted into the department, who, in terms of their moral, business and moral qualities, meet the requirements for candidates for service in the internal affairs bodies. Candidates who committed violations in the field of road safety, who had complaints at work and at home, are not accepted for service, ”the Ministry of Internal Affairs for the Trans-Baikal Territory says in a response to Chita.ru.

"Ivan Ivanov" claims that the dismissal from the service turned into serious medical and financial problems for him. “I was worried about the inability to continue to serve the cause to which I worthily devoted my significant share of my life. Due to the realization of the loss of my job, I did not sleep well and was anxious. I could not meet the urgent needs of my family and the obligation to pay the mortgage loan, ”he wrote in his lawsuit. Together with his colleagues, Ivanov demanded that the court recognize the refusal of the Ministry of Internal Affairs in hiring unreasonable, force the police department to reinstate him in his position and pay him 100,000 rubles in compensation. “No one, of course, is going to actually work with such leadership. They came up with phrases in the style of "red-haired people are prone to corruption." At the same time, people in the Central Internal Affairs Directorate work with “conditions,” says Ivanov.

During the consideration of the claims of “Ivanov” and his comrades, representatives of the disbanded Federal Drug Control Service did not give characteristics to the drug police who decided to sue the Ministry of Internal Affairs, and the decision on their employment was left to the discretion of the court. Representatives of the police department in court repeated that the employees of the disbanded FSKN did not pass the RSD check, Sukachev said.

“FSKN employees were fired in June, and in July Federal Law 305 was adopted, which specified the situation with police officers, from recruitment and transfer to work to retirement. However, all the same, the police interpreted it in their favor,” says the lawyer. On what grounds the employees of the Federal Drug Control Service were not hired, representatives of the Ministry of Internal Affairs did not explain.

As a result of the proceedings, the court found no grounds to satisfy the claim of "Ivanov". The resolution states that the recruitment specific person is a right, not an obligation, of the employer. Similar rulings were issued on the claims of other employees of the FSKN. Some of them plan to appeal the decision to the Trans-Baikal Territory Court, where the materials of the RSD audit are expected to be studied. According to Sukachev, the decisions made by the courts are actually identical - all of them do not even indicate the opinion of the prosecutors. “There is no opinion of the prosecutors, the decisions say “taking into account the opinion of the prosecutors” and that’s it. Employees of the Federal Drug Control Service say that they have never seen prosecutors,” the lawyer notes.

According to “Ivanov”, the Trans-Baikal Regional Court is expected to consider the complaints of his comrades in September. Even if later the court obliges the Ministry of Internal Affairs to accept him for service, the former drug police officer is not going to stay there for a long time.

“In any case, when I recover, I will rebound to another region within a year. Otherwise, they will simply let them go to waste, bring them under some kind of article, God forbid, not a criminal one, we have such people there. But we will recover, we will go to the end. Not everyone, of course, nervous system strong, someone left to work as a taxi driver, to somehow move to the construction site or to the zone, ”summed up Ivanov.

Planned renewals

There is no information yet on the appeals of FSKN employees to the court in other regions. Some regional departments of the Ministry of Internal Affairs sparingly report on the re-registration of drug police in the ranks of their employees. In Omsk, the head of the new drug control department (UKON), Yevgeny Chizhov, said that the staff of 127 people is almost complete and ready to fight drugs, including on the Internet, where drug dealers Lately are the most active. That is why, he explained, preference was given to people with economic education and knowledge of IT when recruiting employees. In Nizhny Novgorod, about 400 former employees of the FMS and about 200 people from the Federal Drug Control Service have already been hired by the Ministry of Internal Affairs. In total, 554 and 292 people worked in the local departments of the liquidated departments, respectively.

IN Sverdlovsk region the post of head of the drug control department was taken not by a native of the Federal Drug Control Service, but by the former deputy director of the criminal investigation department of the police headquarters, Vladimir Molodtsov. He said that the new department is staffed by at least 50% of the Federal Drug Control Service. “The operational service of the State Drug Control Service has passed to us in full force. Some employees are employed in the territorial divisions of the head office. No one is offended, everyone has found their place, ”he said. Molodtsov assured that the officers retained their ranks, and the police accepted civilian representatives of the Federal Drug Control Service into their ranks. Former heads of the Federal Drug Control Service and the Federal Migration Service were left without work. This was stated in the press service of the department. Viktor Ivanov and Konstantin Romodanovsky were not appointed to the Ministry of Internal Affairs. Vladimir Putin on Tuesday abolished the Federal Drug Control Service and the Federal Migration Service by his decrees. One of the reasons was that these structures duplicate the powers of the Ministry of Internal Affairs. There will be a reduction in personnel, and it would be more difficult for former leaders to dismiss subordinates, Vyacheslav Smirnov, director of the Institute of Political Sociology, believes.

“Hard work is ahead to unite the former drug inspectors with the departments for combating drugs in the Ministry of Internal Affairs, and the reduction there will be mutual. The same will apply to the system of the Federal Migration Service, apparently, our future migration service will be more repressive and will be primarily aimed at limiting migration, so there will also be a personnel purge. The trend itself is positive, because when the structures parallel each other, and there is not enough budget money, the main funds are spent on personnel, this raises big questions, ”Smirnov explained to Kommersant FM.

Now the Ministry of Internal Affairs will create the Main Directorate for Migration and the Main Directorate for Drug Control. Migration issues will be supervised by the first deputy head of the ministry Alexander Gorovoy. Konstantin Romodanovsky has headed the FMS since 2005. Viktor Ivanov has been in charge of the Federal Drug Control Service since 2008. In the Ministry of Internal Affairs, his powers will now be performed by Deputy Minister Mikhail Vanichkin. According to the presidential decree, employees of the Federal Migration Service and the Federal Drug Control Service will be hired by the Ministry of Internal Affairs, but the staff of the migration service will be reduced by 30%.

There are ideas about more radical measures in the fight against drug addiction - punishment for use.

The Federal Drug Control Service and the Migration Service were liquidated as independent federal services by presidential decree in April 2016, their functions were transferred to the Ministry of Internal Affairs. The Government of the Russian Federation earlier ordered to complete liquidation measures to abolish departments by July 1, 2017, later this period was extended until October 1.

The Ministry of Health reported to RIA Novosti that statistics show a decrease in the primary incidence of drug addiction disorders. In 2016, this indicator decreased by 17.1%, amounting to 156.7 cases per 100,000 population (against 189.1 cases in 2015). The prevalence of substance abuse disorders is also decreasing: last year this indicator decreased by 9.3% compared to 2015 (1642.3 cases per 100 thousand of the population against 1811.1 cases). At the same time, the values ​​of long-term remission rates among all narcological patients are increasing, the Ministry of Health noted.

Active interaction

Yevgeny Bryun, chief narcologist at the Ministry of Health of the Russian Federation, told RIA Novosti that the number of drug addicts in the country has slightly decreased over the year since the liquidation of the Federal Drug Control Service. This, according to him, became possible thanks to interagency cooperation.

According to a specialist from the Ministry of Health, a drug testing program for students was launched over the past year, and in general the situation is stabilizing. “We test and identify students who use drugs, we carry out preventive measures with these guys there, this is the main thing. And the number of drug addicts in the country has slightly decreased, so we believe that the situation is stabilizing,” Bryun said.

According to him, it is difficult to determine what this trend is connected with, but it is worth noting active actions all interested departments: the state is actively working to solve the problem, not only the Ministry of Internal Affairs, but also other departments, both education and health care, are engaged in the prevention of drug addiction; it gives its results, said the interlocutor of the agency.

"The police are better at catching, doctors are better at detecting, education is also involved in identifying and educational programs. That is, by joint efforts we educate families, parents, this also gives its results. It is probably impossible to say that any one department is a priority, this is such a problem that can only be solved by everyone - and civil society and the state in active interaction. Then the results are obtained," Brune said.

He clarified that a program has now been launched to identify those who abuse alcohol and drugs among patients in ordinary somatic hospitals.

"We identify up to 15% of people who have somatic diseases, there are cardiological, gastroenterological, pulmonological. These 15% are associated with alcohol or drug abuse. So we started such a program ... it will expand to outpatient clinics for the early detection of alcohol and tobacco abusers and drugs. So such a program has been launched, and it is developing," the narcologist said.

As RIA Novosti was told in the Ministry of Health, interdepartmental interaction on control over the circulation of narcotic drugs, psychotropic substances and their precursors is carried out within the framework of the activities of the State Anti-Drug Committee and interdepartmental working groups.

"It should be noted that integration at the level of interdisciplinary relationships between narcological specialists and specialists from other medical fields is currently continuing, which is an important part of the system for the prevention of narcological disorders and, to one degree or another, diseases and conditions associated with them," the Ministry of Health specified.

The department notes the prospect of organizing and actively maintaining joint activities narcological services and medical prevention services.

The system of assistance to drug addicts in Russia

A question of efficiency

At the same time, the opinions of parliamentarians on the effectiveness of the fight against drugs over the year that has passed since the liquidation of the Federal Drug Control Service have diverged. Thus, the head of the State Duma Committee on Security and Anti-Corruption, Vasily Piskarev (United Russia), said that the work on the fight against drugs in the Russian Federation after the liquidation of the Federal Drug Control Service is being carried out very effectively.

"The work is carried out very effectively. For the police, the fight against drug trafficking is traditionally one of the most important areas, so they both worked and continue to work. I do not see any negative consequences after the reform that has taken place. The situation has not become worse. We are seeing the arrest of the perpetrators and seizure of drugs, and this is the main thing," Piskarev told RIA Novosti, adding that for a more detailed analysis of the situation, it is necessary to request relevant statistics from the Ministry of Internal Affairs.

"The elimination of drug control had a negative impact on the fight against drugs. Unfortunately, the Ministry of Internal Affairs has too many areas of work, and the fight against drugs, unfortunately, is not a priority for them. There are more serious, in their opinion, groups of crimes that need to be dealt with. Most the main thing is that the staff of people “on the ground”, operational workers who are engaged in the fight against drugs, identifying the spreaders of this infection, has been reduced,” Yemelyanov told the agency; according to the parliamentarian, the number of operational officers in some cities of the Russian Federation has decreased three times.

Irina Yarovaya, Vice Speaker of the State Duma, stressed that the fight against drug crime is a comprehensive state policy. “Each department, within the limits of its competence, must necessarily increase the effectiveness of its work in the fight against drug crime, based on an understanding of the special danger of these crimes and the importance of protecting public and state security, protection younger generation, against which the narcotic weapons of criminals are primarily turned, ”Yarovaya told RIA Novosti.

At the same time, the politician noted that drug addiction is a global problem, in the fight against which Russia is the initiator of many solutions. "Russia has initiated many international decisions and insists on creating an antiterrorist coalition, because the drug business is also a source of financing for terrorism," she said.

Yarovaya also recalled that in a comprehensive public policy, which is integral part national security strategies, includes initiatives within the framework of the Financial Action Task Force on Money Laundering (FATF), as well as decisions at the legislative level. In particular, she explained, such as the establishment of life imprisonment for the production and sale of drugs, the procedure for classifying new substances in the list of psychotropic and narcotic drugs, mandatory drug testing for a number of professions and exemption from liability subject to treatment, rehabilitation measures and resocialization of drug addicts.

Radical measures and the new Federal Drug Control Service

At the same time, some deputies speak of the need to turn to radical measures, up to the introduction of liability for the use of prohibited substances. For example, Yemelyanov believes that it is necessary to re-establish a special agency for the fight against drugs. “I believe that the liquidation of the Federal Drug Control Service was a mistake ... I would return the specialized agency for the fight against drugs, of course,” he said.

At the same time, the deputy did not rule out the need to turn to such radical anti-drug measures as “tougher punishment”, introducing punishment for drug use, “because prevention does not work very well.”

"The most important thing is to strengthen the responsibility for promoting the use of drugs," the parliamentarian said. Yemelyanov explained that now “everywhere on youth channels you can hear that drug addiction is curable”, that light drugs are “it’s not scary that addiction does not occur” and so on. The deputy is sure that there should also be responsibility for such "propaganda of drugs, for reducing the aversion to drugs."

Nevertheless, it is hardly worth waiting for the relevant bills in the near future. “We are discussing them at the expert level, but the fact is that there is a serious lobby that opposes the adoption of such measures, unfortunately. Under the pretexts of humanity and so on. Although, in fact, this is not humanity, but lobbying the interests of the drug lobby,” the deputy said, answering the question of whether the relevant bills should be expected in the near future.

As shown by a recent VTsIOM poll conducted on the eve of international day fight against drugs, more than three-quarters of Russians (78%) approve the idea of ​​introducing criminal penalties for drug use. The vast majority of Russians (93%) also spoke out against the free sale of any drugs; but every tenth respondent aged 18-34, like 14% of residents of capital cities, according to VTsIOM, allows the legalization of “soft” drugs. The Federal Drug Control Service of Russia was to be disbanded by June 1, 2016. This is stated in the decree of the President of the Russian Federation, dedicated to the abolition of this service. Prior to its disbandment, the State Drug Control Service had a significant arsenal of weapons, which were in the possession of operational officers and special forces soldiers of the Federal Drug Control Service "Grom".
